Terms of Service
Effective June 28, 2026 · Fieldwork, Inc.
These Terms of Service (the “Terms”) are a binding agreement between you and Fieldwork, Inc. (“Fieldwork,” “we,” “us,” or “our”) and govern your access to and use of the Fieldwork websites, applications, APIs, and related services (collectively, the “Service”). Please read them carefully. By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company.
1. The Service
Fieldwork is a marketplace and operations platform that connects technology companies (“Clients”) with technical content creators and key opinion leaders (“Creators”), and provides tooling to discover Creators, run campaigns, manage deals, automate outreach, and measure performance. We provide the platform that facilitates these relationships; we are not a party to any agreement between a Client and a Creator unless expressly stated in a separate written agreement.
2. Eligibility & accounts
You must be at least 18 years old and capable of forming a binding contract. You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account. Notify us promptly at max@webmakers.cc of any unauthorized use.
3. Subscriptions, fees & billing
- Retainers & plans. Paid plans are billed as recurring monthly retainers or as otherwise described at purchase. Fees are stated in U.S. dollars and are exclusive of taxes unless noted.
- Payment processing. Payments and invoices are handled by our payment processor (Stripe). By providing payment details you authorize us and our processor to charge the applicable fees.
- Auto-renewal. Subscriptions renew automatically each billing period until cancelled. You may cancel future renewals at any time; cancellation takes effect at the end of the current period.
- Refunds. Except where required by law, fees are non-refundable and partial periods are not pro-rated.
- Late or failed payment. We may suspend or limit the Service for overdue amounts.
4. Client & Creator relationships; no guarantee of results
Campaign matching, suggested rates, outreach drafts, and performance projections are provided for convenience and are generated in part by automated and AI systems. They are estimates, not guarantees. Fieldwork does not warrant any specific reach, conversion, revenue, or other outcome. You are solely responsible for your decisions, your contracts with counterparties, and the content you publish or commission.
5. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated by reference. In particular, all outbound communications you send or cause to be sent through the Service must comply with applicable anti-spam and marketing laws (including, where applicable, the CAN-SPAM Act, CASL, and the GDPR/ePrivacy rules).
6. Your content & data
You retain ownership of content and data you submit (“Customer Data”). You grant us a worldwide, non-exclusive license to host, process, and use Customer Data solely to provide and improve the Service and as described in our Privacy Policy. You represent that you have the rights and lawful basis to provide Customer Data, including any third-party personal data (such as prospect or Creator contact details) you upload or generate.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by Fieldwork and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, reverse engineer, or create derivative works of the Service.
8. Third-party services
The Service integrates third-party providers (including Anthropic, Stripe, Resend, Cal.com, Supabase, and others). Your use of those features may be subject to the providers’ own terms, and we are not responsible for third-party services.
9. Confidentiality
Each party may receive non-public information of the other. The receiving party will protect such information with reasonable care and use it only to perform under these Terms, except for information that is public, independently developed, or required to be disclosed by law.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED OUTPUT WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY.
12. Indemnification
You will defend and indemnify Fieldwork against third-party claims arising from your Customer Data, your campaigns and communications, or your breach of these Terms or applicable law.
13. Term & termination
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or to comply with law. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.
14. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The parties will attempt to resolve disputes informally first; any unresolved dispute will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless a binding arbitration provision is added here by counsel.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app). Your continued use after changes take effect constitutes acceptance.
